Border States Keep Close Eye on Va. Marriage Case

Several states are closely watching a federal case over Virginia's gay marriage ban Tuesday.

The 4th Circuit Appeals Court is hearing arguments from same-sex marriage proponents trying to overturn the law. The case will not only affect marriage laws in Virginia but three other states as well.

North Carolina, South Carolina, and West Virginia have similar marriage laws and all three are covered by the same appeals court.

In the case of in Bostic v. Schaefer, lower court Judge Arena Wright Allen ruled in February that Virginia's ban on gay marriage is unconstitutional.

An appeals court ruling affirming Allen's decision could either strike down bans or virtually ensure the success of similar lawsuits in the other states. It could take the court several weeks to reach a decision.

So far, 18 states and the District of Columbia allow gay marriage.
