One Step Forward, Two Steps Back for Obamacare
President Barack Obama's signature healthcare law took one step forward and another back with two opposite rulings Tuesday on the law's subsidy provision.
A Washington, D.C., federal court ruled the U.S. government isn't authorized to give tax subsidies in the 36 states that refused to set up their own state Obamacare exchanges.
The Internal Revenue Service rewrote the subsidy regulation after these states opted out of the exchange, allowing all 50 states to be subsized regardless.
Meanwhile, a Virginia federal court ruled the opposite. It said the IRS correctly interpreted the will of Congress by allowing subsidies in all 50 states.
