Judge: Kentucky Gay Marriage Ban Unconstitutional

A federal judge in Kentucky struck down the state's ban on same-sex marriage, saying it's unconstitutional.

U.S. District Judge John G. Heyburn's decision did not deal with whether the state would have to issue marriage licenses to same-sex couples.

"Assuring equal protection for same-sex couples does not diminish the freedom of others to any degree," he said.

The implementation of Heyburn's ruling, however, was temporarily placed on hold. It's unclear when the state can begin issuing licenses to same-sex couples.

Kentucky's governor plans to appeal the ruling.

Meanwhile in Indiana, a federal appeals court ordered the state to recognize the marriage of a lesbian couple because one of the women is terminally ill. The couple married in another state.
