Judge Sides with Doctor in Late-Term Abortion Case

A Kansas judge has sided with a doctor who lost her license in a late-term abortion case.

Dr. Ann Kristin Neuhaus had provided second opinions in cases for the late Dr. George Tiller. Tiller needed them under Kansas law to legally terminate the pregnancies of 11 young patients, ages 10 to 18.

The State Board of Healing revoked Neuhaus' license in 2012 for failing to provide adequate mental health exams in those cases.

The board ruled her records didn't show she had done thorough examinations.

But Monday, the judge's ruling became public. Shawnee County District Judge Franklin Theis ordered the board to reconsider its sanctions.

"In this Court's view, such an inference is too slim, too frail, and too conjectural to support any of his conclusions reached beyond a breach of adequate record keeping," the court order states.

One of Neuhaus' attorneys reacted to the ruling, saying it was "pretty consistent" with her arguments.
