Planned Parenthood and the American Civil Liberties Union (ACLU) filed a federal lawsuit against the state of Indiana over a newly passed pro-life law. The law bans selective abortions based on an unborn child's sex, race or genetic disability such as Down Syndrome.

A federal judge set a June 14 hearing to consider the challenge.

"What is absolutely absurd about this is that there are federal laws that protect people being discriminated against on the basis of race, sex or disability, yet, what we have is Planned Parenthood trying to do even worse -- actually killing these children, murdering these babies because of these instances," Matthew Clark, with the ACLJ, told CBN News.

"Medically, we see a lot of the times... the tests... that show maybe a potential disability often end up being wrong, which means that these children are being needlessly killed, and that is something that must stop. It's something that's critical in the pro-life fight across the nation," Clark said.

The executive director of the ACLU Jane Henegar calls the Indiana law unconstitutional and says it goes against privacy rights.

"We're taking direct action to fight back, preparing a critical amicus brief to defend these precious unborn babies from gruesome slaughter," ACLJ Chief Counsel Jay Sekulow wrote in an email. "No child should be murdered because he or she is considered inferior. Yet, that's the sick mentality that Planned Parenthood was founded on."

"We could effectively save thousands of children every year across the country if these laws are put into place," Clark said. "And this is a critical instance, a critical test case in Indiana, and it's a case that we are committed to -- defending the lives of these babies."

Indiana Governor Mike Pence and other pro-life supporters say the law values unborn children and disabled people.

"The parties on both sides -- ACLU for Planned Parenthood and the state of Indiana -- will be submitting briefs and other supporting documentation to the court in support of their respective arguments," Henegar said.

In the last five years, federal courts have overruled two other Indiana laws that were against abortion.
