A federal judge in Oregon is set to hear arguments Wednesday over the state's ban on same-sex marriage.

However, Oregon's attorney general is refusing to defend the voter-approved ban, so no one will be in court to argue on its behalf.

Now, the National Organization for Marriage is requesting to defend the law.

U.S. District Judge Michael McShane says he'll rule on NOM request first and if he determines the group has legal standing, he he'll hear new arguments.
