Man Undeterred by Dismissal of Gay Marriage Suit

A county commissioner in Milwaukee, Wisconsin, dismissed a man's lawsuit against county officials who are issuing same-sex marriage licenses.

Wisconsin's battle over the state's gay marriage ban is still pending in the federal courts, but county clerks started issuing same-sex marriage licenses anyway -- something Robert Braun says is illegal.

Braun filed a $10,000 suit in small claims court in an effort to halt the issuing of licenses and ensure the state's gay marriage ban is upheld.

"If I hadn't filed it I'd be waiting six months to get this heard. Now I've got a court case, it's on file and I know what he's going to say. I'm prepared now when I go in so it's a big step for me," Braun said.

But on Monday, Commissioner Grace Flynn dismissed his lawsuit.

"It's a court of money, not principal," she said.

Braun said expected his claim to be dismissed, but he at least wanted it on the books. He said his next stop is the Circuit Court.
