The U.S. House of Representatives is moving ahead with its plans to sue President Barack Obama over the implementation of Obamacare.

Weeks after Speaker John Boehner, R-Ohio, announced the lawsuit, House Republicans released a draft of the resolution Thursday that would authorize the House to file the litigation.

They're seeking to challenge the White House's decision to delay the health care law's employer mandate until 2016.

"In 2013, the president changed the health care law without a vote of Congress, effectively creating his own law by literally waiving the employer mandate and the penalties for failing to comply with it," Boehner said in a statement.

"That's not the way our system of government was designed to work. No president should have the power to make laws on his or her own," he added.

Republican lawmakers have long complained that Obama overstepped his authority by delaying portions of Obamacare, especially the employer mandate.
